1. Acceptance of Terms

By accessing or using AI Academy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are a parent or guardian creating an account for a child, you accept these Terms on behalf of your child and are responsible for their use of the Service. If you do not agree to these Terms, you may not use the Service.

2. Account Registration

To use AI Academy, you must create an account:

  • Student Accounts: Students may register with a first name, year level, and 4-digit PIN. Students under 13 should have parental permission to create an account.
  • Parent Accounts: Parents create accounts with their name and password, and receive a unique parent code to link their children's accounts. Parents are responsible for managing their children's access and monitoring their learning activity.
  • Accurate Information: You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.
  • Account Security: You must not share your password or PIN with others. Notify us immediately of any unauthorised use of your account.

3. Subscription and Payments

AI Academy offers both free and premium subscription tiers:

  • Free Tier: Provides access to core learning features, including diagnostic tests, exercises, and progress tracking. Free accounts may have usage limits or restricted features.
  • Premium Tier: Unlocks unlimited exercises, advanced analytics, personalised learning paths, priority support, and additional content. Pricing details are available on our website.
  • Payment: Premium subscriptions are billed monthly or annually in Australian dollars (AUD). Payment is processed securely through our third-party payment provider.
  • Cancellation: You may cancel your premium subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months or unused time.
  • Price Changes: We reserve the right to modify subscription prices with 30 days' notice. Existing subscribers will be notified before price changes take effect.

4. Acceptable Use

You agree to use AI Academy only for lawful, educational purposes. You must not:

  • Share accounts, passwords, or PINs with unauthorised users.
  • Attempt to circumvent access controls, security features, or usage limits.
  • Use the Service to cheat on external assessments or homework without teacher/parent consent.
  • Upload, transmit, or distribute malicious code, viruses, or harmful content.
  • Harass, bully, or harm other users (if multi-user features are introduced).
  • Reverse engineer, decompile, or attempt to extract source code from the Service.
  • Use automated scripts, bots, or scrapers to access or collect data from the Service.

Violation of these terms may result in account suspension or termination without refund.

5. Intellectual Property

All content on AI Academy—including exercises, questions, explanations, graphics, software, and design—is the intellectual property of Tiny Ore Pty Ltd or our licensors and is protected by Australian and international copyright laws.

  • Limited Licence: We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for personal, educational purposes only.
  • Prohibited Uses: You may not reproduce, distribute, modify, publicly display, or create derivative works from our content without prior written permission.
  • User Content: Any feedback, suggestions, or ideas you provide to us may be used by AI Academy without compensation or attribution.

6. AI-Generated Content Disclaimer

AI Academy uses artificial intelligence (Anthropic's Claude API) to generate personalised learning hints and explanations. While we strive for accuracy, AI-generated content may occasionally contain errors or inaccuracies.

  • Not Professional Tutoring: AI Academy is a supplementary learning tool, not a replacement for professional tutoring, classroom instruction, or qualified educators.
  • Parental Supervision: Parents and educators should review AI-generated hints and monitor student learning to ensure content appropriateness and accuracy.
  • No Guarantees: We do not guarantee specific learning outcomes, exam results, or academic improvements from using the Service.

7. Limitation of Liability

To the maximum extent permitted by Australian law:

  • No Warranties: The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Service Availability: We do not guarantee uninterrupted, error-free, or secure access to the Service. Downtime may occur for maintenance, updates, or technical issues.
  • Limitation of Damages: AI Academy, Tiny Ore Pty Ltd, and our affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including loss of data, profits, or academic performance.
  • Maximum Liability: Our total liability to you for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so these limitations may not apply to you. You may have additional rights under Australian Consumer Law.

8. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Australia.

9. Changes to Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify users via email (where available) or through a prominent notice on our platform at least 14 days before the changes take effect.

Your continued use of AI Academy after the effective date of updated Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any conduct we deem harmful to the Service or other users. Upon termination, your right to access the Service immediately ceases.

You may terminate your account at any time by contacting us or using account deletion features within the Service. Upon termination, your data will be handled according to our Privacy Policy.
